1. Heard Mr. Prateek Sharma, learned counsel appearing for the appellant as well as Mr. Sangharsh Pandey, learned Government Advocate appearing for the respondents/State and Mr. Yogesh Kumar Chandra,
learned counsel appearing for the respondents No.4 to 6.

The present writ appeal has been preferred against the order dated 23.10.2024 passed by the learned Single Judge in W.P.(C) No. 239 of 2022, whereby the writ petition challenging the order dated 05.01.2022 passed by the Returning Officer (Panchayat) in relation to the acceptance of nomination in the Panchayat election was dismissed on the ground of availability of the statutory remedy of an election petition under Section 122 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993.
3. The appellant has filed the present writ appeal seeking for the following
3 reliefs:-
“It is, therefore, most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the impugned order dated 23.10.2024 (ANNEXURE A/1), passed in W.P.(C) No. 239/2022 by Hon'ble Single bench of this Hon'ble Court and this Hon'ble Court may kindly be pleased to set aside order dated 05.01.2022 (ANNEXURE P/1 in the writ petition), passed by respondent no. 3, in the interest of justice.”

In view of the submission made by learned counsel for the appellant that, by efflux of time, the tenure of the elected body has already come to an end and the relief sought in the present writ appeal has become incapable of being granted, the present writ appeal is dismissed as having become infructuous.
