During the course of investigation, it was found that the account of one Uma Shankar Ojha, who was a small time worker, had been taken over by the present petitioner and Uma Shankar Ojha had given his cheque book, ATM card, SIM card etc. to the petitioner for a sum of Rs.50,000/-. Thereafter, the said account is stated to have been used in 16 online frauds.
4.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner is willing to join investigation and abide by any condition imposed by the Court.
5.
Per contra, learned State counsel has opposed the prayer for the grant of anticipatory bail stating that such offences are on the rise and custodial interrogation of the petitioner would be required. He further submits that one more FIR with similar allegations, i.e. FIR No.26 dated 06.08.2024 under Section 318(4) of the BNS stands registered against the petitioner at Police Station Cyber Crime, Sirsa.
YAG DUTT 2026.07.23 18:30 I attest to the accuracy and authenticity of this
order/judgment.
CRM-M No.37205 of 2026 -4-
6.
I have considered the submissions made by learned counsel for the parties.
7.
Such like offences are on the rise and day in and day out, people are being defrauded of huge amounts. The modus alleged to have been used in the present case is of an account of a poor person having been taken over by the petitioner and having been subsequently used in 16 online frauds. One more FIR with similar allegations is stated to be pending against the petitioner. In the considered opinion of this Court, custodial interrogation of the petitioner would be imperative to elicit the truth. Still further, if the concession of anticipatory bail is extended to the petitioner, he may try to influence the investigation.
8.
That being so, the petition is found to be devoid of merit and is accordingly dismissed.
