Das … for the petitioner(s) Mr. Koustav Lal Mukherjee … for the State-respondent(s) Learned advocate for the petitioner submits that the foundational facts of the present case relate to an incident of 2024 and the complaint has been lodged on or about 08.06.2026. Learned advocate for the State opposes the prayer for anticipatory bail as there was an allegation of extortion being made at the behest of the present petitioner and the same was upon the persons who use to ply Toto at the locality. Having considered that the incident has been complained in the year 2026, I am of the view that the 2 investigation of the case may continue but custodial detention of the present petitioner may not be warranted in the facts and circumstances of the present case. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Soumendra Nath Dutta @ Soumendranath Dutta] be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, the petitioner shall meet with the Investigating Officer of the case within ten days from date and on all subsequent dates as would be fixed by the Investigating Officer of the case for the sake of investigation. Accordingly, CRM (A) 1983 of 2026 is disposed of. Memo of evidence submitted be kept with the record.
