2. Mr. Ajay Veer Pundir, learned Counsel for the respondents appearing through V.C.
3. Petitioner is serving on contract in Gurukul Kangri Vishwavidyalaya (deemed to be University) at Haridwar ever-since 2012. According to him, he is fully qualified for appointment as Assistant Professor (Mechanical Engineering), therefore, he has earned a right to be considered for appointment against a sanctioned vacant post. It is further his contention that as per ‘Gurukul Kangri Vishwavidyalaya Rules for the Self-Finance Scheme, 2009’, especially Rule 8 of the said Rules, he is entitled for emoluments and other monetary benefits at par with other regular teachers serving in the corresponding Grade, however, that benefit is not paid to him. Thus, feeling aggrieved, petitioner has approached this Court seeking following relief(s): - (a) Issue a writ, order, or direction in the nature of Mandamus directing the Respondent University to release to the Petitioner all service emoluments and monetary benefits as are admissible under Rule 8 of the Gurukul Kangri Vishwavidyalaya, Haridwar Rules for Self-Finance Scheme, 2009.
(b) Issue a writ, order, or direction in the nature of Mandamus directing the Respondent University to continue the Petitioner's services and not to replace him with another set of contractual/ad hoc faculty.
2026:UHC:2759-DB (c) Issue a writ, order, or direction in the nature of Mandamus directing the Respondents to release to the Petitioner the arrears of all service emoluments, including revised pay, dearness allowance, and annual increments, from the dates on which they became due, together with interest at the rate of 18% per annum on the said amounts till the date of actual payment.”

Mr. Ajay Veer Pundir, learned Counsel appearing for Gurukul Kangri Vishwavidyalaya submits that since petitioner has made a representation to the Registrar of ‘Gurukul Kangri Vishwavidyalaya’ on 31.08.2024, therefore, competent authority shall take decision thereupon within a specified time frame.

Learned Counsel for the petitioner, however, submits that petitioner be permitted to make a fresh detailed representation highlighting all aspects of the matter.
6. The writ petition is, accordingly, disposed of with liberty to petitioner to make a fresh representation for ventilation of his grievances. If he makes such representation within three weeks from today, decision thereupon shall be taken as per law by passing a reasoned order within three months thereafter.
7. For a period of four months or till the decision of representation, whichever is earlier, engagement of petitioner shall not be discontinued.
8. Pending application, if any, stands disposed of.
