1. By the present writ petition, the petitioner seeks quashment of the
order dated 14.07.2026 (Annexure P/1), whereby the additional charge of Manager, Adim Jati Seva Sahkari Samiti Maryadit, Jamjhor, Registration No. 263, has been withdrawn from the petitioner and entrusted to respondent No.3.
2.
Learned counsel for the petitioner submits that the petitioner is working as Manager of Adim Jati Seva Sahkari Samiti Maryadit, Kotba, and was also holding the additional charge of Manager of Adim Jati Seva Sahkari Samiti Maryadit, Jamjhor. He submits that, vide impugned order dated 14.07.2026, the aforesaid additional charge has been withdrawn from the petitioner and the same has been entrusted to respondent No.3, without affording any opportunity of hearing and merely citing administrative reasons. It is, therefore, submitted that the impugned order is arbitrary and unsustainable in law. 3. Per contra, learned State counsel opposes the submissions made by the petitioner and submits that the petitioner was only entrusted with the additional charge of Manager, Adim Jati Seva Sahkari Samiti Maryadit, Jamjhor, which was purely temporary in nature. He submits that withdrawal of such additional charge and entrustment thereof to respondent No.3 was made for administrative reasons and does not affect the substantive post or service of the petitioner. Therefore, no legal right of the petitioner has been infringed and the impugned order does not suffer from
3 any illegality warranting interference under Article 226 of the Constitution of India. 4. I have heard learned counsel for the parties and perused the pleadings as well as the documents appended to the writ petition. 5. It is not in dispute that the petitioner was holding the additional charge of Manager, Adim Jati Seva Sahkari Samiti Maryadit, Jamjhor, which was entrusted to him only as an additional and temporary arrangement. The competent authority, for administrative exigencies, has withdrawn the said additional charge from the petitioner and entrusted the same to respondent No.3. Since the petitioner continues to hold his substantive post, withdrawal of the additional charge does not affect his substantive service or any vested right. The petitioner, therefore, cannot claim continuation of such additional charge as a matter of right. 6. As the impugned order merely makes an administrative arrangement with regard to an additional charge and does not visit the petitioner with any penalty or affect his substantive appointment, the contention regarding non-affording of an opportunity of hearing does not warrant interference. This Court, in exercise of jurisdiction under Article 226 of the Constitution of India, would not ordinarily interfere with such administrative arrangements in the absence of any demonstrable illegality or arbitrariness. 7.
In view of the aforesaid discussion, this Court finds no illegality, arbitrariness or perversity in the impugned order dated
4 14.07.2026 (Annexure P/1), warranting interference in exercise of writ jurisdiction. 8. Accordingly, the instant writ petition, being devoid of merit, is liable to be and is hereby dismissed at the motion stage. Sd/- (BIBHU DATTA GURU)
