The petitioner is one of the members of Raninagar-II Panchayat Samiti and seeks a direction upon the Prescribed Authority/Sub-Divisional Officer to convene a meeting for election of the Sabhapati of the Samiti consequent upon resignation of the Sabhapati. Learned counsel for the petitioner submits that though the statutory time limit of 30 days has lapsed, the Prescribed Authority has not convened the meeting. The office of the Sabhapati fell vacant upon his resignation on July 15, 2026. No meeting has yet been convened by the Prescribed Authority for election of a new Sabhapati. In terms of Rule 6(1) of the West Bengal Panchayat (Constitution) Rules, 1975, the Prescribed Authority and Sub-Divisional Officer, Domkol Sub-Division, being the 4th respondent herein, is directed to convene the meeting
within 10 days from the date of communication of this order with concurrence of the District Panchayat Election Officer. The Officer in Charge, Raninagar Police Station, being the 7th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting is held peacefully and without any disturbance from any corner whatsoever. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
