Learned counsel for the petitioner submits that the petitioner, a senior-most Food Officer/Assistant Director, was posted at Balod vide order dated 23.04.2025 and has now been transferred to the Directorate vide the impugned order dated 06.08.2026, within about one year and four months, despite there being no vacant post of Assistant Director at the Directorate. It is further submitted that against three sanctioned posts of Assistant Directors at the JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2026.08.18 10:35:32 +0530
2 Directorate, as many as seven persons are presently posted, whereas several posts of Food Officers are lying vacant in different districts. Despite availability of such vacant posts, private respondent No.3 has been posted in place of the petitioner.
Learned counsel further submits that the transfer is not on account of any administrative exigency, but is actuated by mala fide considerations. At this juncture, learned counsel for the petitioner seeks permission to submit a representation before the Committee constituted under Clause 8 of the Transfer Policy and prays that the same may be considered and decided in accordance with law.
2. Learned State counsel submits that, in case the petitioner submits a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy, the same shall be considered and decided in accordance with law.
3. I have heard learned counsel for the parties and perused the record.
4. Considering the nature of the grievance raised by the petitioner and the submission made by learned State counsel, without expressing any opinion on the merits of the case, the petitioner is
directed to submit a representation before the competent Transfer Committee constituted under Clause 8 of the State Transfer Policy within a period of 10 days from today. In case such representation is submitted within the aforesaid period, the competent Transfer Committee shall consider and decide the same by passing a
3 reasoned and speaking order, strictly in accordance with law and the applicable Transfer Policy, preferably within a period of 20 days thereafter.
5. With the aforesaid observations, the present writ petition stands
