Mr. Shibaji Kumar Das Mr. Dipendu Sarkar Ms. Deblina De. …for the petitioner. Mr. L. Vishal Kumar Mr. Sanjib Das. …for the State. Affidavit-of-service filed by the petitioner be kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case. State has produced the case diary and drawn the attention of the Court to the statement under Section 183 of the BNSS. On perusal of the same, I am of the opinion that although a case has been made out but custodial detention of the present petitioner is unwarranted. As such, the prayer for 2 anticipatory bail of the petitioner is allowed. Accordingly, in the event of arrest, the petitioner, namely, Nayan Mondal shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, petitioner will appear before the court within a period of four weeks from date. Petitioner is further imposed condition that till the evidence of the victim is over, petitioner shall not enter into the jurisdiction of Chakdah Police Station. With the aforesaid observations, CRM(A) 2642 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
