18.08.2026 Serial no. 05 Court no.551 (MKP) CRM (A) 2368 of 2026 In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Kaliachak PS Case No. 1064 of 2025 dated 16.06.2025 u/s 126(2)/115(2)/117(2)/118(2)/109/74/351(2)/3(5) of the BNS 2023. -And- In the matter of : Islam Sk.@Sekh and Ors. … Petitioners Mr. Kazi M. Rahman ………….for the petitioners Mr. Soumya Raha …………..for the State-respondents(s) 1. There are allegations of assault by the petitioners. 2. As per the case made out in the first information report the petitioners are alleged to have assaulted the defacto complainant by fists, blows and with sharp cutting weapons with an intention to kill. 3. As a result of such assault, the victim received severe injuries and was treated for such injuries. The material in the case diary discloses that the injury charge-sheet stands submitted against 15(fifteen) accused persons. 4. The injury report contained in the case diary goes to show that victim received 6 to 8 cm injury on the head and 2 to 4 cm on the forehead. Injuries have been 2 classified as grievous in nature. There are statements in the case diary which places the petitioners on the date and time of the incident. 5. Learned advocate for the State opposes the prayer for the anticipatory bail. 6. In such circumstances, considering the nature of allegations as well as the materials in the case diary, I am of the opinion that this is not a fit case for granting anticipatory bail. 7. Hence, the prayer for anticipatory bail of the petitioner is Rejected. 8. CRM(A) of 2368 of 2026 is dismissed. (Md.Shabbar Rashidi. J)
