Learned advocate appearing for the petitioner submits that petitioner is in custody since June 2023. Till date the evidence of the victim could not be completed and the prosecution, on the garb of requirement of interpreter, had been stretching the time. Petitioner as such is unnecessarily languishing in custody. Earlier State was directed to submit a report of the Superintendent of Police, Murshidabad. A report has been submitted by the Superintendent of the said District which
2 reflects that an interpreter has been organized. However, on the last occasion, i.e. on 12.08.2026, the victim had a school examination, as such, she could not appear and the next date has been fixed on 02.09.2026. The Superior Officer of Police has assured that interpreter has been organized.
Learned advocate appearing for the defacto complainant opposes the prayer for bail.
I have taken into account the overall circumstances, the stage of the case. At this stage, when the evidence of the victim is yet to be recorded by the learned Special Court, I am not inclined to release the petitioner on bail.
Petitioner will renew his prayer for bail after the evidence of the victim is over.
Accordingly, CRM (M) 1693 of 2026 is dismissed.
Report submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner.
