After addressing the argument for some time, learned counsel for the petitioner has filed a memo. Memo reads as under: "It is submitted that the trial court convicted the petitioner for payment of Rs.14,05,000/-. The appellate court confirmed the said conviction. As per order of this Hon'ble Court, the petitioner remitted an amount of Rs.7,00,000/- on 23.01.2023. a such this Hon'ble Court may permit the petitioner to pay the balance amount of Rs.7,05,000/- within 6 months in the interest of justice and equity." 2. Amount in deposit is ordered to be withdrawn by the complainant if not already withdrawn, under due identification. 5. It is made clear that if there is any default in the payment of balance amount as agreed in the memo, then the petitioner shall undergo imprisonment as ordered by the Trial Magistrate confirmed by the First Appellate Court. 6. After the payment of the compensation amount, the amount paid in this proceeding shall be taken note of while adjudging the amount of liability in the pending proceedings before the Assistant Registrar of Cooperative societies.
