Instant writ petition under Article 226 of the Constitution of India has been preferred by the petitioner seeking following reliefs :- (10.1) That the Hon’ble Court may kindly be pleased to call for the the entire records pertaining to the case of the petitioner. (10.2) That, the Hon’ble Court may kindly further be pleased to direct the respondent authorities to pay compensation of rupees 477196 with 9 % interest for acquired land of the petitioner. (10.3) the Hon’ble Court may kindly further be pleased to direct the respondent authorities to pay compensation of entire land of 0.166 hectare. (10.4) Cost the petition may also be granted. 2. Learned counsel appearing for the petitioner submits that the petitioner is land oustee, award has been passed, despite that amount of compensation has not been paid to him. He further submits that much area of his land has been utilized by respondents for construction of road, but in the award lesser area has been mentioned, hence, he prays that this petition may be disposed of directing respondent No. 2 /Sub Divisional officer (Revenue) to pay amount of compensation in lieu of the land acquired by the respondents – Department and further allowing the petitioner to file fresh representation before respondent No. 2 / competent authority for redressal of his grievances pertaining to the actual land utilized by the respondents and the same may be 3 directed to be decided by respondent No. 2/competent authority within a specific time frame. 3. Per contra, learned counsel for the respondents have no objection to allow the limited prayer made by counsel for the petitioner. 4. Having considered the limited prayer made by counsel for the petitioner, this petition is disposed of directing respondent No. 2 – Sub Divisional Officer (Revenue), Gaurela-Pendra-Marwahi to pay amount of compensation within a period of 30 days from the date of receipt / submission of copy of this order, upon due verification, if there is no legal hindrance and further liberty is granted to the petitioner to move fresh representation for raising his grievance pertaining to the actual area of land, which has been acquired and utilized by the respondents. 5. With the aforesaid observations & directions, the petition stands disposed of.
