This petition has been filed by the applicant under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking a direction to the learned Principal Judge, Family Court, Durg, to decide the application preferred by the applicant under Section 311 of the Cr.P.C./Section 348 of the BNSS, 2023 in Case No. 155/2024 whereby the applicant seeks to call for the bank account records allegedly maintained by his wife. 2. From perusal of record, it is quite vivid that the learned Family Court, vide order dated 01.07.2026, has kept the aforesaid application in abeyance, observing that as and when necessity arises, an appropriate order may be passed. Thus, the application has neither been rejected nor allowed, but has merely been kept in abeyance. 3. In view of the above, the applicant may proceed with the cross- examination and if during the course of the proceedings, the necessity for consideration of the aforesaid application arises, the learned Family Court shall consider and decide the same, in accordance with law. 4. With the aforesaid observation, the instant Cr.M.P. stands disposed of.
