Jaysree Ghosh Mr. Supriyo Ghosh Ms. Susmita Adhikary Mr. Ashis Bhukta Mr. Sandipan Dinda …for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant and is directed against order no. 118 dated September 18, 2025 passed by the learned Judge, 3rd Bench, Presidency Small Causes Court in Ejectment Suit No. 377 of 2008. By the order impugned the application filed by the petitioner praying for permission for effecting necessary repairs, stood rejected. Learned advocate appearing for the petitioner submits that the tenanted property is in a dilapidated condition and the same requires urgent repairs. However, after going through the application for permission for effecting repairs this Court finds that the petitioner has not specifically mentioned the items of the work of repairs. It also does not appear that the petitioner took any step for holding local inspection for bringing the 2 clear picture before the Court as to the condition of the suit property. That apart, the suit is at the stage of evidence of the defendants and one of the witnesses have already been examined. Learned trial judge has assigned cogent reasons for rejecting the application for repairs. This Court is not inclined to interfere with such order. Accordingly, this civil revision application stands dismissed without, however, any order as to costs. (Hiranmay Bhattacharyya, J.)
