CRR 3413 of 2026
Madhumita Roy
Vs.
Rajat Subhra Roy
Mr. Moyukh Mukherjee Ms. Sarmistha Basak …for the Petitioner
In this application, the petitioner herein has prayed for a direction upon the court below for expeditious disposal of M. case no. 760 of 2023 filed under Section 125 of the Code of Criminal Procedure, presently pending before the learned Judicial Magistrate, 2nd Court, Barasat. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned counsel for the petitioner submits that the petitioner initiated the said proceeding on 18.10.2023 and the opposite party entered appearance on 23.2.2024 and the matter was adjourned for filing affidavit of assets by the husband/opposite party. But since then, the matter is pending and no further progress of the said proceeding has taken place for the last two and half years and therefore, he prayed for necessary direction upon the court below for disposal of the said proceeding. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.
2 Having considered the submissions made on behalf of the petitioner and that the proceeding has practically got stalled for more than two and a half years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 3413 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid proceeding and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
