Mr. Neeraj Garg, Advocate, for the petitioner. Mr. Lalit Sharma, Deputy SG, with Mr. Manoj Kumar, Central Govt. Standing Counsel, for the respondent no. 1 to 4. (2) As per office report, substitution applications (IA/5/2024 and IA/11193/2024) are filed within time. Prayer for substitution is not opposed by learned Counsel appearing for the respondents. For the reasons indicated, substitution applications are allowed. Amended memo of parties be filed by 20.4.2026. (3) Petitioner was engaged through outsourcing agency as Lower Division Clerk in CGHS Dispensary in Dehradun in March, 2010. He served continuously in that capacity till 18.10.2022. Learned Counsel for the petitioner contends that services of petitioner were arbitrarily terminated w.e.f. 19.10.2022, even though work and post was available. Thus feeling aggrieved by the termination order dated 18.10.2022 and consequential letter issued on 21.10.2022, petitioner filed the writ petition in 2022, in which an interim order was passed on 12.12.2022 providing that “if new hands are to be engaged by respondents no. 2 and 3, preference may be given to petitioner in view of his wide experience”. During pendency of the writ petition, petitioner passed away on 22.11.2023. (4) Learned Counsel for the petitioner submits that even though petitioner served up to 18.10.2022, however he was not paid salary for certain months. He submits that there are other pending dues of the petitioner with the respondents, therefore a direction deserves to be issued to the respondents to clear all 2026:UHC:2762 pending dues of the petitioner. (5) Mr. Lalit Sharma, learned Deputy SG appearing for the respondents, however, disputes the said submission, but he concedes that if there are any pending dues, then legal heirs of the petitioner can make a representation to the competent authority, who will release whatever dues are to be released. (6) In such view of the matter, writ petitions are disposed of by permitting legal heirs of the petitioner to make representation regarding pending dues of the petitioner to the respondent no. 3. If such representation is made within three weeks from today, decision thereupon shall be taken, as per law, by passing a reasoned order within six weeks thereafter.
