CMP(M) No.221 of 2026 As per report of the Registry, the respondent stands duly served, but none has put in appearance on his behalf. Consequently, he is proceeded ex parte. The present application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that the impugned judgment was passed by the learned District Judge, Bilaspur on 03.12.2024. The District Attorney, Bilaspur, intimated the department about the dismissal of the appeal. On receipt of the communication, as issued by the District Attorney, the case file was sent to the Superintending Engineer and thereafter the case remained at different levels and in this process, the delay has occurred in filing the present appeal. The grounds for the delay have been explained in para-3 of the application, which are reasonable and plausible. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view of submissions as made by learned Deputy Advocate General, the present application is allowed and delay in filing the appeal is condoned. Accordingly, the application stands disposed of.
