---- 02/02.04.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Saria P.S. Case No.155 of 2025 for the alleged offences registered under Sections 318(4), 88 and 3(5) of Bharatiya Nyaya Sanhita and Section 23(1) of P.C.P.N.D.T. Act, 1994, pending in the Court of learned Judicial Magistrate 1st Class, Giridih.

Learned counsel appearing for the petitioner submits the petitioner was earlier granted a license to operate a Nursing Home in the name of Maa Kaushalya Sewa Sadan but due to some reason it was closed by the petitioner on 22.01.2023 and has kept the articles of the nursing home in the house of his uncle and was preparing to start another nursing home but that was not functional, however the investigating team got suspicious and thought that it was functional and on the basis of that the FIR has

been registered and false allegations is made of sex determination test was being done by the petitioner.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there of indulging in sex determination test.

Considering that the petitioner has already closed the said Maa Kaushalya Sewa Sadan and it has been pointed out that the articles have been kept in the house of his uncle, however, the raid has been made and thereafter the FIR has been lodged and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
