D/L9 13.08.2026 Bpg. C.R.M. (A) 1786 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Berhampore Women Police Station Case No.108 of 2025 dated 26.08.2025 under Sections 127(7)/351(2)/61(2)/70(1) of the Bharatiya Nyaya Sanhita, 2023 and 3/4/5/6/7 of Immoral Traffic (Prevention) Act, 1956; Bakbul Hossain @ Dablu Versus The State of West Bengal & Anr. Mr. Moyukh Mukherjee Mr. Anisur Rahaman. …for the petitioner. Mr. Pinaki Bhattacharyya Mr. Amartya Mohan Bhattacharyya. …for the State. Mr. Pinaki Bhattacharyya and Mr. Amartya Mohan Bhattacharyya, learned advocates, appear on behalf of the State. Their appearance may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that the petitioner is innocent and has been falsely implicated in connection with the instant case even the victim did not name the present petitioner. Apart from the same, there are no materials which are appearing and in spite of the same, the police authorities are chasing him. The case diary was handed over to this Court on an 2 earlier occasion. I have taken into account the statement of the victim which from the inception stated regarding three accused persons having ravished the victim. Subsequently, certain photographs were handed over and seized by the investigating authorities. Having taken into account the fact that the present is a case of anticipatory bail and petitioner’s nick name appears in some of the statement, I am not inclined to extend the benefit of anticipatory bail to the present petitioner. Accordingly, CRM(A)1786 of 2026 is dismissed. Case diary be returned to the learned advocate appearing for the State. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Tirthankar Ghosh, J.)
