JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: “i) Issue writ of mandamus directing the Respondents to pay a sum of Rs.9,67,275/- with interest thereon @ 18% per annum from the date of retirement till realization of the amount to the 1st Petitioner and a sum of Rs.4,95,007/- with interest thereon @ 18% per annum from the date of retirement till realization of the amount to the 2nd Petitioner; and ii) Pass any appropriate order or orders as this Hon’ble Court deems fit in the interest of justice, including the cost of litigation in the interest of justice and equity.” - 3 - HC-KAR NC: 2026:KHC:20301 WP No. 6977 of 2026 2. Heard learned counsel for the petitioner and perused the material on record. Respondents having been served with notice have chosen to remain unrepresented and have not contested the petition. 3. After arguing the matter for sometime, learned counsel for the petitioner submits, petition may be disposed of reserving liberty in favour of the petitioner to submit a fresh/new representation to the respondents, who may be directed to consider the same and proceed further and take appropriate action as expeditiously as possible. 4. The aforesaid submission is placed on record. 5. Under the aforesaid facts and circumstances, I deem it just and appropriate to dispose of the petition by issuing certain directions. In the result, I pass the following: ORDER i) The petition is hereby disposed of. - 4 - HC-KAR NC: 2026:KHC:20301 WP No. 6977 of 2026 ii) Liberty is reserved in favour of the petitioner to submit a fresh/new representation including judgments of this Court and Hon’ble Apex Court and relevant documents to the respondents. iii) If the petitioner submits such a representation along with relevant documents including judgments of this Court and the Hon’ble Apex Court etc., the concerned respondent shall consider the same and take appropriate decision/pass appropriate orders bearing in mind the documents produced to be produced by the petitioner within a period of two months from the date of submission of the said representation. iv) All rival contentions on all aspects of the matter are kept/left open and no opinion is expressed on merits/demerits of the rival contentions.
