…..Petitioner Petitioner REKHA SHARMA 2026.07.24 05:47 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh he petitioner has clean antecedents. no useful purpose would be served by keeping the petitioner in custody any longer. Per contra, learned State counsel has opposed the bail application stating that two other cases under the NDPS Act stand registered against the petitioner. 6. I have considered the submissions made by learned counsel for the parties. 7. No doubt the allegations are serious. However, the fact remains that the main accused Satish Suman who was arrested first in point of time has already been granted regular bail vide order dated 04.05.2026 passed in CRM- M-3359 of 2026. The fact remains that after having been in custody for the last more than two years, the trial has not proceeded at a pace it should have, and out of 27 witnesses only 07 have been examined till now. This has, in the considered opinion of the Court, seriously prejudiced the right of the REKHA SHARMA 2026.07.24 05:47 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court, Chandigarh petitioner to a speedy trial. It is, therefore, clear that the trial will take a sufficiently long time to conclude and, therefore, no useful purpose would be served by keeping the petitioner in custody any longer. 8. Keeping in view the aforesaid facts and the fact that two co- accused have already been granted regular bail by a Coordinate Bench, this Court does not deem it appropriate to deny the concession of regular bail to the present petitioner. Accordingly, without expressing any opinion on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on their furnishing bail/surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
