JUSTICE E.S.INDIRESH ORAL ORDER Heard the learned counsel appearing for the parties. 2. In the present writ petition, the petitioner has sought a direction to Respondent No. 3-Assistant Commissioner to consider the application dated 02.01.2019 filed by the petitioner seeking phodi durasth in respect of the subject land. 3. It is the case of the petitioner that he is the owner in possession of an extent of 01 acre 4½ guntas of land in Sy.No.23 situated in Madhuvanahally - 4 - HC-KAR CNR: KAHC010221422025 NC: 2026:KHC:42604 WP No. 10659 of 2025 Village, K.R. Nagar Taluk, Mysuru District, having acquired the same under a registered Sale Deed dated 22.06.2007. Thereafter, the revenue entries were mutated in favour of the petitioner. 4. It is further stated that Respondent No. 5- Thasildar, upon considering the application made by the petitioner, passed an order dated 30.05.2019, directing Deputy Thasildar, to ascertain whether the original land records pertaining to the land in question were available. 5. Upon careful consideration of the submissions made by the learned counsel appearing for the parties and the letter dated 17.12.2021 (Annexure-E1), whereby Respondent No. 5 addressed a letter to Respondent No.3 to prepare the records pertaining to the subject land based on the list furnished therein. It is evident that Respondent No. 5 - 5 - HC-KAR CNR: KAHC010221422025 NC: 2026:KHC:42604 WP No. 10659 of 2025 had directed Respondent No.3 to prepare the necessary documents/records in accordance with the list provided. 6. A perusal of Annexure-E1 dated 17.12.2021 would further indicate that Respondent No. 5 had addressed the said letter to Respondent No. 3 for preparation of the missing records pertaining to the subject land. In that view of the matter, it is the duty of Respondent No. 3 to prepare the missing records pertaining to the land in question within an outer limit of six months from the date of receipt of a certified copy of this order. 7. In view of the above, the reasons assigned in the Endorsement dated 01.02.2025 (Annexure-G) issued by the respondent No.5-Thasildar cannot be accepted. It is also open to the petitioner to furnish any documents that may be necessary to enable Respondent No. 3 to prepare the missing records, if the same is required.
