1. The order of the Municipal Building Tribunal dated 31st July, 2026 in Appeal No.28 of 2025 is under challenge in this application under Article 227 of the Constitution of India. 2. None appears on behalf of the Kolkata Municipal Corporation. 3. Mr. Debjit Mukherjee, learned advocate who usually appears for the Kolkata Municipal Corporation is present in Court and is requested to appear in this matter to represent the Kolkata Municipal Corporation. Let the appointment of Mr. Mukherjee along with Ms. Susmita Chatterjee be regularized by the concerned authority. A copy of the instant revisional application has

been served upon Mr. Mukherjee by the learned advocate for the petitioner. 4. Mr. Mukherjee, learned advocate appearing for the Kolkata Municipal Corporation, submits that the action of demolition is being taken in terms of an order passed by the Hon’ble Division Bench in a public interest litigation being WPO(P) 1 of
2025. He submits that the said public interest litigation came up for hearing today (07.08.2026) before the Hon’ble Division Bench and the petitioner appeared before the Hon’ble Division Bench and submitted that the petitioner was not impleaded as a party in the said public interest litigation. He further submits that after considering the submission of the learned advocate for the petitioner, the Hon’ble Division Bench did not pass any order on such submission but left the petitioner free to take steps in accordance with law. Mr. Mukherjee, learned advocate for the Kolkata Municipal Corporation, on instructions, also submits that the work of demolition is being carried on strictly in terms of the orders dated 19th June, 2025 and 3rd July, 2026 passed by the Hon’ble Division Bench in WPO(P) 1 of 2025. 5. Faced with such submission, the learned advocate appearing for the petitioner prays for

leave to withdraw this civil revisional application with liberty to approach the appropriate forum. 6.
In the light of the submissions made by the learned advocate for the petitioner, CO 2563 of 2026 is dismissed as withdrawn with liberty to the petitioner to take appropriate steps in accordance with law. 7. All parties shall act on the basis of server copy of this order, duly downloaded from the official website of this Court. 8.
