Supplementary affidavit filed on behalf of the petitioner be kept with the record. Learned advocates appearing for the petitioner and the opposite party no.2 are present. Pursuant to change of circumstances both the parties have taken out a joint compromise application. On the basis of the information furnished by the opposite party no.2, Bhaktinagar P.S. Case No. 130 of 2025 dated 09.02.2025 was registered for investigation under Sections 126(2)/115(2)/74 of the BNS, 2023. Pursuant to the investigation having been concluded, charge-sheet was submitted under the same provisions of law. I have taken into account the nature of the allegations and the series of cases pending inter se the parties. Having considered the averments made in the joint compromise 2 petition and taking into account the genesis of the disputes along with the report forwarded by the Inspector-in-Charge, Bhaktinagar Police Station which encloses a communication made by the de facto complainant/opposite party no.2, I am of the view that in the changed circumstances where the parties have amicably settled their disputes, further continuance of the proceedings is unwarranted. Accordingly, all further proceedings arising out of Bhaktinagar P.S. Case No. 130 of 2025 dated 09.02.2025 including the charge-sheet submitted therein corresponding to G.R. Case No. 613 of 2025 pending before the learned Chief Judicial Magistrate, Jalpaiguri or any court within his jurisdiction are hereby quashed. Consequently the revisional application being CRR 176 of 2025 along with CRAN 1 of 2025 is allowed. Report submitted by the learned advocate appearing for the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
