1. Affidavit of service filed on behalf of petitioner is taken on record.
2. By presenting this writ petition petitioner prays for direction upon the concerned police authorities which will preserve his right over the agricultural land in question thereby enabling the petitioner to cultivate the land and get usufruct of that land.
3. Learned advocate representing respondent nos. 4 and 5 has opposed this writ petition and it is submitted that agricultural land in question is owned by respondent nos. 5 and 6 and petitioner does not have right over the said land.
4. State respondents are represented by learned advocate who has filed a communication dated 12th August, 2026 of Officer-in-Charge,
2 Gurguripal Police Station, Paschim Medinipur and same is taken on record. Copies of said communication are made over to the learned advocates representing petitioner and respondent nos. 5 and 6.
5. It is disclosed in the communication that based on complaint lodged an FIR was registered being Gurguripal Police Station Case No. 100 of 2026 dated 10th August, 2026 under certain provisions of BNS.
6. Police authorities are directed to investigate the case and take the same to its logical conclusion by submitting report before the jurisdictional Magistrate.
7. If petitioner finds that his right to cultivate land in question is infringed by the private respondents in that event petitioner needs to approach appropriate forum in pursuit of remedy.
8. Police authority is not the appropriate authority to decide inter se right of the parties over the land in question.
9. With the aforesaid observations writ petition stands disposed of.
