JUSTICE E.S.INDIRESH ORAL ORDER 1. In this Writ Petition, petitioner is assailing the endorsement dated 20.02.2026 (Annexure-Q) issued by respondent No.4. Sri. Chowdareddy T.M., learned counsel appearing for the petitioner further submits that the petitioner is assailing one another endorsement dated 14.05.2026(Annexure-T) issued by respondent No.4 which has been produced along with a memo dated 09.06.2026. 2. Heard Sri. Chowdareddy T.M., learned counsel appearing for the petitioner and Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for the respondents. 3. Having heard the learned counsel appearing for the parties and on careful consideration of the material on record would indicate that respondent No.3 has passed the order dated 29.07.2025 (Annexure-N) rejecting the application made by the petitioner for restoring the land as 'sarkari beelu' stands in the name of father of the petitioner, and the said order was - 4 - HC-KAR CNR: KAHC010157702026 NC: 2026:KHC:43358 WP No. 7168 of 2026 challenged before this Court in W.P.No.29832/2025 and this Court, vide order dated 06.02.2026 (Annexure-P) allowed the Writ Petition and as such remanded the matter to respondent No.4 to take decision in the matter in accordance with law. Further, it is forthcoming from the Writ Petition records, that the order passed by this Court in SHIVANNA Vs. THE DEPUTY COMMISSIONER, TUMAKURU DISTRICT AND OTHERS in W.P.No.19639/2021 disposed of on 05.09.2022 was consistently followed by this Court in W.P.No.5957/2024 disposed of on 17.06.2025(Annexure-U), against which the State Government had preferred W.A.No.485/2026 and the Division Bench of this Court vide Judgment dated 09.04.2026(Annexure-V) disposed of the appeal preferred by the State Government by confirming the order dated 05.09.2022 passed by this Court in SHIVANNA case in W.P. No.19639/2021(supra). 4. In that view of the matter, I find force in the submission made by the learned counsel appearing for the petitioner, that the respondent No.4 has committed an error in issuing the - 5 - HC-KAR CNR: KAHC010157702026 NC: 2026:KHC:43358 WP No. 7168 of 2026 endorsement dated 20.02.2026 at Annexure-Q and the endorsement dated 14.05.2026 at Annexure-T. 3. Accordingly, I pass the following: ORDER (i) The Writ Petition is allowed. (ii) The endorsement dated 20.02.2026(Annexure-Q) and the endorsement dated 14.05.2026(Annexure-T) issued by respondent No.4, are hereby set aside. (iii) Respondent No.4 is directed to restore the revenue records in the name of father of the petitioner within one month from the date of receipt of certified copy of this order.
