None appears for the opposite party on call. 3. It is the case of the petitioner that she has filed the Title Suit No. 214 of 2022, for recovery of possession of the suit property which was gifted in her favour by the opposite party/husband. 4. Subsequently, the petitioner along with two children was forcibly dispossessed from the said property. A copy of the said gift deed is annexed to the revisional application. The petitioner/wife also submits that it has become very difficult to reside without proper accommodation and as such she prays for such transfer of the Title Suit No.214 of 2022 under Section 34 of the Specific Relief Act, 1963 pending before the Court of Learned 2nd Civil Judge (Jr. Div.) at Uluberia, Howrah to the competent court at Barrackpore, North 24 Parganas. 5. Considering the said difficulty of the petitioner/wife to travel to Uluberia on regular basis, this Court relying 2 upon the judgments of the Hon’ble Supreme Court in N.C.V. Aishwarya vs A.S. Saravana Karthik Sha, in Civil Appeal No(s). 4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12), directs that Title Suit be withdrawn from the Court of Learned 2nd Civil Judge (Jr. Div.) at Uluberia, Howrah and be transferred to the Court learned Civil Judge (Jr. Div.) at Barrackpore, North 24 Parganas. 6. The learned Civil Judge (Jr. Div.) at Barrackpore shall proceed with the suit in accordance with law with due notice upon both the parties. 7. Keeping in mind the case of the opposite party herein, the learned Civil Judge (Jr. Div.) at Barrackpore, shall be at liberty to permit the opposite party to appear virtually, if such prayer is made. 8. CO 4461 of 2025 stands disposed of. 9. Parties to act on the server copy of this order. Let a copy of this order be sent to the concerned Courts for immediate complianc [Shampa Dutt (Paul), J.]
