Accused No.1 in Crime No.52/2026 was registered by Bagalur Police Station, Bengaluru, for the offences punishable under Sections 8(c) and 22(C) of the NDPS Act, 1985, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.52/2026 was registered by Bagalur Police Station, Bengaluru, for the aforesaid offences based on the first information dated 22.02.2026 received from Keshavamurthy K, PSI attached Bagalur Police Station. In the said case, petitioner was taken into custody on 22.02.2026 and remanded to judicial custody. Her bail application filed before the Court of Special Judge in Crl.Misc.No.533/2026 was rejected on 17.04.2026. Therefore, she is before this Court. 4. It is the case of the prosecution that based on credible information, petitioner was apprehended on 22.02.2026 and from her possession, 3000 pills allegedly MDMA ecstasy pills - 3 - HC-KAR CNR: KAHC010487322026 NC: 2026:KHC:44165 CRL.P No. 10616 of 2026 were recovered and subjected to panchanama. The seized contraband article was also subjected to proceedings under Section 52A of the NDPS Act and thereafter, sample of the drug was forwarded to the Forensic Science Laboratory for the purpose of chemical examination. The report issued by the Forensic Science Laboratory would reveal that sample of the contraband article has responded negative to MDMA and positive to Tapentadol, which is a synthetic opioid analgesicdrug. Learned HCGP fairly submits that the said drug is not a contraband article. The said submission is placed on record. Under the circumstances, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.52/2026 was registered by Bagalur Police Station, Bengaluru, for the offences punishable under Sections 8(c) and 22(C) of the NDPS Act, 1985, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 4 - HC-KAR CNR: KAHC010487322026 NC: 2026:KHC:44165 CRL.P No. 10616 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts her appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against her is disposed off.
