The petitioner has filed this petition seeking following relief (s) : “10.1 That, the Hon'ble Court may kindly be pleased to call for the entire record relating to his case. 10.2 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the case of petitioner and grant for promotion from the date from which it was made applicable on similarly situated persons. 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondent authorities to maintain her seniority. 10.4 Any other relief/relief's which may deem fit and proper in the facts and circumstances of the case may also be allowed.” 2. Ms. Jha, learned counsel appearing for the petitioner would submit that the petitioner was appointed to the post of Shiksha Karmi Grade-III at Middle School Baigatola, Block Khairagarh vide order dated 02.02.1999, and her services were regularized on 02.02.2002. She would further submit that the petitioner was transferred from Middle School Baigatola to Primary School Amlidihkhurd vide order dated 13.07.2009. She would also submit that, as the petitioner had completed the qualifying service for promotion to the post of Teacher Panchayat in the year 2017, her name was recommended by the Chief Municipal Officer, Nagar Palika Parishad, Khairagarh, to the Chief Executive Officer, Zila Panchayat, Rajnandgaon, and subsequently, her name was also recommended by the Block Education Officer, Khairagarh, but till date, no decision has been taken. She would contend that, as the petitioner is posted in the urban area, her claim has not been considered yet. She would further contend that a direction may be issued to the Chief Executive Officer, Zila Panchayat, 3 Rajnandgaon, to take an appropriate decision with regard to the promotion of the petitioner to the post of Teacher Panchayat. 3. On the other hand, learned counsel appearing for the respondents would oppose the submissions. They would submit that the petitioner cannot claim promotion as a matter of right. They would further submit that the services of the petitioner have already been absorbed by the School Education Department; therefore, the Chief Executive Officer, Zila Panchayat, has no authority of law to take any decision with regard to the promotion of the petitioner. 4. Heard learned counsel appearing for the parties and perused the documents placed on record. 5. Having considered the fact that the name of the petitioner was recommended for promotion to the post of Teacher Panchayat by the Chief Municipal Officer, Nagar Palika Parishad, Khairagarh, and the Block Education Officer, Khairagarh, way back in the year 2017-18, but till date, no decision has been taken, therefore, this petition, at this juncture, is disposed of reserving liberty in favour of the petitioner to make a representation before the Chief Executive Officer, Zila Panchayat, Rajnandgaon/Khairagarh, within a period of 30 days and in turn, the said authority is directed to take an appropriate decision thereon within a period of 90 days from the date of receipt of such representation. 6.
