While the matter was being heard, learned counsel appearing for the respondents submitted that the instant petition has been rendered infructuous in view of the fact that the respondents have issued a fresh tender notice vide No. CEO/SDA/2026/35-43 dated 04.04.2026. It was further submitted that, in such circumstances, the relief prayed for by the petitioner cannot be granted at this stage, as the petitioner only has a right to participate in the fresh tender process. 2. When confronted with the aforesaid position, learned counsel for the petitioner sought permission to withdraw the instant petition with liberty to avail appropriate remedy in accordance with law. 3. The submission of learned counsel for the petitioner is accepted. Accordingly, the writ petition is dismissed as withdrawn, with liberty as prayed for.
