Learned advocate for the petitioner submits that the petitioner has been implicated in the present case pursuant to 1800 bottles of Eskuf cough syrup being recovered from a godown which was rented by the father of the present petitioner namely, Asraful Islam. Learned advocate further submits that since the investigation is in progress, the petitioner apprehends that he may be implicated in connection with the instant case, as such, learned advocate prays that the petitioner may be enlarged on bail. 2 Learned advocate for the State opposes the prayer for anticipatory bail and draws the attention of the court to the seizure list which has been made. Additionally, the attention of the court has been dawn to the agreement which is a part of the case diary. More than three and half months have passed since the initial seizure was effected and there has been no further seizure. Having considered the locus of the present petitioner, at this stage, I am of the opinion that although the investigation may be taken to its logical conclusion but custodial detention of the present petitioner may not be warranted in the facts and circumstances of the present case. As such, I am inclined to enlarge the petitioner on anticipatory bail. Hence, the prayer for anticipatory bail of the petitioner is Allowed. Accordingly, I direct that in the event of arrest, the petitioner [Md. Ashik Ikbal @ Asik Rana Mondal] be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2)
3 of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As the investigation is in progress, the petitioner shall meet with the Investigating Officer of the case within a period of 10 days from date, thereafter, on all subsequent dates as would be fixed by the Investigating Officer of the case for the sake of investigation. Accordingly, CRM (A) 1980 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. (Tirthankar Ghosh, J.)
