Mr. Rohan Banshi. …for the State. Learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in connection with the instant case. Learned advocate for the State has produced the case diary. Memo of Evidence submitted reflects that notice under Section 35(3) of the BNSS has been complied with. I have taken into account that the charge-sheet has already been submitted. As such, I am of the view that custodial detention of the present petitioner is unwarranted. Accordingly, the prayer for anticipatory bail of the petitioner is allowed. In the event of arrest, the petitioner, namely, Mamataj 2 Mondal alias Mamtaj Mondal shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the charge-sheet has already been submitted before the jurisdictional court, this order of anticipatory bail will remain in force for a period of six weeks from date. Thus, CRM(A)2639 of 2026 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
