Heard SRi. Saravana S., learned counsel appearing for petitioners and Sri. Yogesh D. Naik, learned Additional Government Advocate appearing for respondents 1 and 2. 3. Sri. Yogesh D. Naik, learned Additional Government Advocate appearing for respondents 1 and 2 raised a preliminary objection and submitted that the petitioners are having an efficacious remedy to file appeal against the impugned orders under Section 106 of the Karnataka Co- operative Societies Act, 1959. 4. Having taken note of the submission made by learned counsel appearing for the parties, on perusal of the averments made in the writ petition, the same would indicate that the disputed question of facts are involved in this petition. Therefore, it is expedient to direct the petitioners to approach the competent authority for redressal of their grievance. - 4 - HC-KAR NC: 2026:KHC:20872 WP NO.25254 OF 2025 5. Accordingly, petitioners are directed to approach the competent authority by filing an appeal in terms of Section 106 of the Karnataka Co-operative Societies Act, 1959. The interim order passed by this Court on 18th August, 2025 shall enure to the benefit of the petitioners for a period of three weeks from the date of receipt of this order. All contentions of the parties are kept open. With this observation writ petition stands disposed of. In view of disposal of the petition, pending application does not survive for consideration.
