IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
CRM-M No.33533 of 2026 Date of Decision:-22.07.2026
Johny …..Petitioner. Versus State of Haryana .....Respondent.
CORAM: HON’BLE MR. JUSTICE VIKRAM AGGARWAL ***** Present:- Mr. Parveen Kumar, Advocate
for the petitioner.
Ms. Vasundhara Dalal Anand, Sr. DAG, Haryana.
VIKRAM AGGARWAL, J. (ORAL)
Prayer in the present petition preferred by the petitioner under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) is for the grant of anticipatory bail in case FIR No.146 dated 15.05.2025 registered under Sections 305 and 334(4) of the Bharatiya Nyaya Sanhita, 2023, at Police Station Quilla, District Panipat.
2.
On the statement of one Shahrukh, the FIR in question was registered, the contents of which are as under:-
“Copy of Statement, Statement of Shahrukh s/o Karam Ilahi, r/o Darbar Khurd, Titarvaha Chungi Kairana Distt. Shamli. Respected Sir, it is prayed that I am the resident of abovesaid address. That I am having a meat shop at Kutani Road, ganda nala. Yesterday night I closed my shop and went to home. Around 3:45 am one of my neighbor called me and YAG DUTT 2026.07.23 18:30 I attest to the accuracy and authenticity of this
order/judgment.
CRM-M No.33533 of 2026 -2-
informed that the shutter of your shop is broken. Then I checked the CCTV of my shop and then it came into light that the theft is committed at my shop. I went to shop with my father and brother and came to know that they have stolen my 12 Goats. Kindly take strict action against them. SD/-”
3.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that the petitioner is willing to join investigation and abide by any condition imposed by the Court.
4.
Per contra, learned State counsel has opposed the prayer for the grant of anticipatory bail stating that the petitioner is a habitual offender, 10 more FIRs having been registered against him and most of them pertaining to offences of theft. She submits that in 06 out of the 10 FIRs, he is on the run and has not joined investigation.
5.
I have considered the submissions made by learned counsel for the parties.
6.
Keeping in view the nature of the allegations and the fact that the petitioner is a habitual offender against whom 10 more FIRs are registered, mostly for theft and he is on the run in the most of them, this Court does not find it to be a case where the concession of anticipatory bail should be extended to the petitioner.
7.
That being so, the petition is found to be devoid of merit and is accordingly dismissed.
