1. Challenge in this petition is to the order dated 05/04/2023 (Annexure-P/1) passed by the Collector, Balrampur- Ramanujganj in Revenue Case No. 202207270100017(09/A-19/2021-22) (Rajesh Maravi v. Mithlesh Kumar Dubey). 2. At the very outset, learned counsel for respondent No. 6 raised an objection with regard to the maintainability of the petition on the ground that the present petition has been filed without preferring a revision against the impugned order passed by the Collector before the Divisional Commissioner, Sarguja Division. 3. At this juncture, learned counsel for the petitioner would submit that at the relevant time, the office of the Divisional Commissioner, Sarguja Division was not functioning and presently the same is functional. As such, the petition may be disposed of with liberty to Petitioner to file a revision before the Divisional Commissioner. He would further submit that till the filing of the revision, the interim order passed by this Court on 18/04/2023 may be continued. 4. Learned counsel for the respondents do not oppose the aforesaid submission made by the learned counsel for the petitioner. 5.
Having considered the rival submissions made by the learned counsel for the parties, the Writ Petition is disposed of with liberty to the petitioner to prefer a revision before the Divisional Commissioner, Sarguja
3 Division. It is further directed that the interim order granted by this Court on 18/04/2023 shall remain operative for a period of 20 days from today. Sd/- Sd/- (BIBHU DATTA GURU)
