By way of this petition, the petitioner has prayed for following reliefs:- RAGHVENDRA JAT Digitally signed by RAGHVENDRA JAT 2 “i. A writ and/or an order in the nature of appropriate writ do issue calling the records of the court below pertaining to the case of the petitioners for perusal of this Hon'ble Court, if this Hon'ble Court thinks fit in the facts and circumstances of the case. ii. A writ and/or an order in the nature of appropriate writ do issue order/directing/issuing for the direction to the respondent authorities to trace the file made on application of the petitioner of the grant of the caste certificate and mention correct case no, in it as the file and further amended caste certificate be issued mentioning correct case no in effect illegality must not be allowed to perpetuated, in the facts of the matter, in the interest of justice. iii. A writ and/or an order in the nature of writ of mandamus do issue directing the respondents authorities to grant appointment in the post of Civil Judge (Junior Division) provisionally and being confirmed after submission of corrected caste certificate deem fit by this Hon'ble Court, in the facts of the matter, in the interest of justice. iv. Any other order that may be deemed fit and just may also kindly be made including cost of the petition.” 2. Learned counsel appearing for the petitioner submits that the petitioner has recently received certain relevant documents which, according to him, have a direct bearing upon the issue involved in 3 the present matter. It is submitted that, in view of the said documents, the controversy can appropriately be examined and decided by the competent authority at the first instance. Learned counsel further submits that the petitioner has already preferred a representation before the concerned Collector, Surguja, raising the grievance involved in the present petition and placing his claim before the said authority. Without entering into the merits of the controversy at this stage, learned counsel for the petitioner submits that the concerned Collector, Surguja, may kindly be directed to consider and decide the representation submitted by the petitioner, along with the relevant documents in support thereof, and to pass an appropriate and reasoned order in accordance with law within a stipulated period. 3. Per contra, learned counsel appearing for the State submits that, for the limited purpose of consideration and decision upon the representation submitted by the petitioner, the matter may be remitted to the concerned Collector, Surguja. It is submitted that the competent authority may consider the representation along with the documents relied upon by the petitioner and take an appropriate decision strictly in accordance with law. 4. I have heard learned counsel appearing for the parties and have carefully perused the material available on record. 5. Having regard to the facts and circumstances of the case and, without expressing any opinion on the merits of the controversy, 4 the present petition is disposed of with a direction to the concerned Collector, Surguja, to consider and decide the representation submitted by the petitioner, along with the relevant documents relied upon by him, in accordance with law. The concerned Collector shall examine the grievance raised by the petitioner and, after affording due consideration to the documents and contentions placed before him, pass an appropriate, reasoned and speaking order on the representation within a period of 15 days from the date of receipt of a copy of this order. 6. It is made clear that this Court has not expressed anything on the merits of the case. 7. With the aforesaid direction, the writ petition is disposed of.
