13.08.2026 IN THE HIGH COURT AT CALCUTTA Item No.49 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Allowed C.R.M. (M) 947 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Goalpokher Police Station Case No. 466 of 2025 dated 04.08.2025 under Sections 319(2)/336(2)/ 336(3)/340(1)/340(2) of the Bharatiya Nyaya Sanhita, 2023 read with Section 14A(b) of the Foreigners Act and charge- sheet submitted under Sections 319(2)/336(2)/ 336(3)/340(2) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 21/22/24 of the Immigration and Foreigners Act, 2025 (G.R. Case No. 2614 of 2025). And In Re : Dilip Biswas ... Petitioner. Mr. Sagnik Roy Chowdhury, Mr. Trijit Mitra ... For the Petitioner. Mr. Kallol Mondal, Ld. PP, Mr. Aditya Tiwari ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than a year. Learned Public Prosecutor appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the period of detention of the present petitioner and the fact that the enquiry is in progress. Be that as it may, having regard to the foundation of the prosecution case and the attending circumstances, I am of the opinion that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner viz., Dilip Biswas shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court. The application for bail, being CRM (M) 947 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
