06.08.2026 Court No.35. D/L.23. Rakib (Rejected)
CRM (NDPS) 1518 of 2026
In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Jagacha Police Station case no. 165 of 2024 dated 23.09.2024 under Sections 20(b)(ii)(C)/29 of the NDPS Act.
And In the matter of : Rohit Shaw.
……Petitioner. Mr. Soumya Basu Roy Chowdhury
.....for the Petitioner. Mr. Gurudas Mitra Mr. Utsav Dutta
……for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than one year ten months, although charge-sheet has been submitted but there is no progress in the trial. Learned advocate appearing for the State opposes the prayer for bail as there has been alleged recovery of 101.700 kg of ganja in the present case. It has been submitted that the prosecution evidence has commenced. Having considered the stage of the case and the quantum of seizure, I am not inclined to release the petitioner on bail at this stage. Petitioner will approach this Court after the evidence of the seizure list witnesses are over.
2 Learned trial Court would give priority to the evidence of the seizure list witnesses and try to complete the same by 31st of December, 2026. With the aforesaid observations CRM (NDPS) 1518 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
