The petitioners are before this Court seeking for the following reliefs: i) Issue a writ in the nature of certiorari quashing of the impugned communication official order dated 10-06-2025 vide Annexure G, passed by 2nd respondent bearing No.HR/2025/9940 - 3 - HC-KAR CNR: KAHC010392512025 NC: 2026:KHC:39123 WP No. 17857 of 2025 ii) Issue a Writ or order or direction as this Hon'ble Court deems fit under the circumstances of the case, in the interest of justice and equity. 2. The petitioner submitted a representation to the Managing Director of Union Bank of India, calling upon him not to give effect to any resolutions that may be passed by the All India Union Bank SC/ST Employees Association in the meetings scheduled to be held on 24.02.2025 and 25.02.2025. The said representation not having been considered, the petitioner had approached this Court by filing WP No.11272 or 2025. This Court vide its order dated 29.04.2025 directed the respondent to consider the representation and pass necessary orders strictly in accordance with law. 3. Subsequent thereto, the Communication has been issued by the General Manager, Human Resources dated 10.06.2025 stating that the Bank has issued necessary guidelines for all Unions to follow. Insofar as any resolution passed by the All India Union Bank SC/ST Employees Association is concerned, The Bank does not have any authority to interfere in the - 4 - HC-KAR CNR: KAHC010392512025 NC: 2026:KHC:39123 WP No. 17857 of 2025 internal meetings of resolution passed by any Trade Union or Association and left the discretion to the petitioner to challenge any resolution passed by the said Union before the appropriate Authority/Court. It is challenging said endorsement that the petitioner is before this court seeking for the aforesaid reliefs. 4. As is evident from the representation, the petitioner, who claims to be a member of the Central Working Committee and an Executive Member of the SC/ST Union Bank of India Association, sought a direction that the resolutions passed by the Trade Union in its meetings held on 24.02.2025 and 25.02.2025 should not be given effect to. The representation was submitted to the employer, namely, Union Bank of India. 5. In my considered opinion, the employer has rightly rejected the representation, stating that it cannot interfere with the day-to-day affairs and functioning of the Trade Union. If the petitioner is aggrieved by any action taken by the Trade Union, it is open to him, as a member thereof, to pursue the matter before the Trade Union and/or the competent - 5 - HC-KAR CNR: KAHC010392512025 NC: 2026:KHC:39123 WP No. 17857 of 2025 authority, in accordance with law. This is precisely what has been conveyed in the impugned communication dated 10.06.2025 6. No infirmity can be found therewith, reserving all rights and leaving all contentions open for the petitioner to agitate before the appropriate forum, the petition stands disposed.
