The ground for granting bail is the period of detention of the accused/petitioner for more than five years five months. Learned advocate for the State submits that five witnesses have been examined out of the 17 witnesses cited in the charge-sheet. Having considered the period of detention of the present petitioner and there being no scope of the trial being concluded within a reasonable period of time, I am of the view that the same benefit be extended to the present 2 petitioner as the other accused who has been granted bail in CRM (M) 1606 of 2026 [Jahangir Mondal]. Hence, the prayer for bail of the petitioner [Samsul Alam Mondal @ Lebu] is Allowed. Accordingly, the petitioner be released on bail on the same terms and conditions as was imposed on Jahangir Mondal in CRM (M) 1606 of2026 Accordingly, CRM (M) 1524 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
