Mr. Mukteswar Maity Ms. Manika Sarkar ….for the petitioner Mr. Arka Bhattacharya Mr. Banshi Badan Maity ……for the State respondents 1) Affidavit of service filed on behalf of the petitioner is taken on record. 2) By presenting this writ petition, petitioner prays for direction upon the concerned police authorities to take steps which would facilitate the petitioner to cultivate land in question as Bargadar. According to the petitioner, since he is recorded Bargadar in connection with agricultural land he has right to cultivate said land. 3) State respondents are represented by learned advocate who submits that concerned police authority has submitted non-cognizable report and steps have been taken to maintain peace and tranquility. 4) Private respondents are not represented. 2 5) Having considered the submissions made on behalf of the petitioner and State respondents, it appears that by presenting this writ petition petitioner is trying to preserve his right as Bargadar and to cultivate land in question which is being obstructed by private respondents. If there are claim and counter claim regarding right of the petitioner and private respondents over the land in question, in that event parties are required to approach appropriate forum in pursuit of remedy. Police authority is not the appropriate authority to decide whether petitioner is having right to cultivate land in question or not. 6) Hence, no further order need be passed on this writ petition and same stands disposed of. 7) However, this order shall not preclude the petitioner to approach appropriate forum in pursuit of remedy. 8) Concerned police authorities are directed to maintain peace and tranquility at the locale and keep vigil. 9) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
