Counsel for the petitioner states that petitioner was awarded a contract for collection of toll/user fee and operation and maintenance of two toll plazas at Jhallian Kalan and Kubbe on Ropar Chamkaur Sahib Neelon Doraha Road. He submits that during the currency of contract, penalty was imposed under Clause 19 of conditions of contract, Annexure P-2. Counsel states that thereafter petitioner wrote numerous letters to competent authorities raising a dispute, but they have not been adjudicated. In particular, he has made a reference to legal notice dated 21.06.2024, Annexure P-15, and representation dated 20.08.2024, Annexure P-17. 2. Advance copy of the petition has been served upon the respondents. From a perusal of the petition, it transpires that legal notice and representation, Annexures P-15 and P-17, respectively, are pending. 6. Accordingly, writ petition is disposed of with a direction to respondent No.2 – The Superintending Engineer, Construction Circle, Punjab, PWD (B & R) Branch, Chandigarh, to decide notice and representation under Clause 26 of the contract agreement within a period of three months from the date of communication of a copy of this order.
