2 learned Deputy Government Advocate for the respondents / State. 2. The petitioner has filed this petition praying for following relief:-
“a) A writ and/or an ordered in the nature of appropriate writ do issue Calling for the relevant records from the concerned court below relating to the petitioner's case for its kind perusal b) A writ and/or an ordered in the nature of appropriate writ do issue quashing the order dated 18/11/2024(Annexure P-1) passed by the Learned Judicial Magistrate First Class, Durg (Chhattisgarh), and impugned ordered dated 02/01/2026(Annexure P-2) passed by 8th district and session judge, Durg Chhattisgarh. c) A writ and/or an ordered in the nature of appropriate writ do issue Direct Respondent No.02 (SHO) to register FIR under Section 318(4) BNS/420 IPC.”
3. A perusal of the present petition reveals that the same suffers from various defects and defaults, as duly pointed out by the Registry in accordance with the Rules of the Court. Despite the same, learned counsel for the petitioner has failed to cure the said defects within the stipulated time and has not shown due diligence in complying with the procedural requirements. Even today, when the matter was taken up for hearing, learned counsel for the petitioner sought an adjournment without addressing or rectifying the objections raised, which reflects a lack of seriousness in prosecuting the matter. 4. On a pointed query being made to the learned counsel for the petitioner as to why he has not cured the abovementioned defects
3 and filed a defective petition, he could not give any satisfactory reply to the same and wasted the precious time of this Court. 5. In view of the same, learned counsel for the petitioner prays to withdraw the present petition with liberty to file afresh. 6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh, subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court and the same shall be transmitted to the Government Home for Mentally Underdeveloped Children, Mana Camp, District- Raipur (C.G.), for wasting the precious time of this Court. 7. Learned Panel Lawyer appearing for respondents / State is present. 8.
