JUSTICE M.NAGAPRASANNA - 3 - HC-KAR CNR: KAHC010389892025 NC: 2026:KHC:42728 CRL.P No. 8408 of 2025 ORAL ORDER Heard Smt. Divya B.N., learned counsel appearing on behalf of Sri. R.Chandra Kumar, learned counsel for the petitioners, Sri. K.Nageshwarappa, learned High Court Government Pleader appearing for respondent No.1, and Sri N.T. Hareesh Kumar, learned counsel appearing for respondent No.2 and have perused the material on record. 2. During the subsistence of the subject proceedings, the parties to the lis have settled the dispute among themselves and filed a joint application. The relevant paras of joint application reads as follows: "It is submitted that to put an end to litigation the Petitioner and Respondent No.1 have amicably settled their dispute as stated earlier and have decided to close the said case, accordingly the Respondent No.2 has no objection for quashing the entire proceedings in CC.No.84/2024, which is pending on the file of the Learned Senior Civil Judge and JMFC, Nagamangala, for the offence punishable under Sections 323, 504, 498-A P Section 34 of the Indian Penal Code and under Section 3 & 4 of the DP Act., arising out of Crime No.125/2023 registered by Respondent No.1. 8. It is submitted that, in view of the amicable settlement arrived at between the petitioner No.1 and the Respondent No.2 respect to all their pending disputes and litigations, both petitioner No.1 and the Respondent No.2 have agreed to withdraw or get dispose of their respective - 4 - HC-KAR CNR: KAHC010389892025 NC: 2026:KHC:42728 CRL.P No. 8408 of 2025 cases instituted by them against each other. The petitioner No.1 and Respondent No.2 is hereby undertake that, in terms of settlement arrived at between them, they shall take appropriate steps to withdraw or otherwise bring to a lawful conclusion all the aforesaid proceedings pending against each other, in accordance with law. WHEREFORE, the Petitioners and Respondent No.2 humbly prays this Hon'ble Court to pleased to permit the Petitioners and Respondent No.2 to compound the said offences and quash entire proceedings in CC.No.84/2024, which is pending on the file of the Learned Senior Civil Judge and JMFC., Nagamangala punishable under Sections 323, 504, 498-A R/w Section 34 of the Indian Penal Code and under Section 3 & 4 of the DP Act., arising out of Crime No.125/2023 in the interest of justice and equity". 3. 3. The learned counsel for the petitioners handed over the Demand Draft for a sum of Rs.10,50,000/- to the respondent No.2 who is present before the Court, and further the counsel undertakes to pay remaining balance amount of Rs.12,00,000/- before the concerned Court. 4. In the light of the settlement arrived at between the parties, I deem it appropriate to accept the joint application and close the proceedings against the petitioners in the subject petition. - 5 - HC-KAR CNR: KAHC010389892025 NC: 2026:KHC:42728 CRL.P No. 8408 of 2025 5. The crime so registered against the petitioners as well as the charge sheet so filed pursuant to the crime in C.C.No.84/2024 stands quashed. 6. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. (ii) Proceedings in C.C.No.84/2024 (Crime No.125/2023) pending before the Learned Senior Civil Judge and JMFC, Nagamangala, stands quashed qua the petitioners.
