Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 259 grams of Heroin and petitioner is in custody for 7 months 27 days. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. The chemical examiner’s report also do not support the present petitioner. Having regard to the totality of the circumstances of the case, I am not inclined to release the petitioner on bail as primarily Section 37 of the NDPS Act is attracted. As such, the prayer for bail of the petitioner is rejected. 2 However, petitioner would renew his prayer for bail after the independent seizure list witnesses are examined. Learned Special Court is directed to split up the trial of the case after exhausting whole of the process of law. Report submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1723 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
