1. The present case has been initiated against the petitioners under Sections 135/138 of the Electricity Act, 2003. The record reveals that the final assessment has been made by the concerned respondent towards the alleged unauthorized use of electricity and, as per the final assessment, an amount of Rs. 3,17,186/- has been shown to be payable by the petitioners. The petitioners undertake to deposit 50% of the said amount within two weeks from date.
2. Learned Advocate appearing for the State submits that a notice under Section 35(3) of the BNSS was issued to the petitioner and that he has complied with the terms and conditions of the said notice.
3. Having heard the learned Advocates appearing for the respective parties and, upon perusal of the case diary and other materials on record, I am of the view that, considering the undertaking given by the petitioner and the fact that he has
2 complied with the instructions contained in the notice under Section 35(3) of the BNSS, the petitioner is entitled to the benefit under Section 482 of the BNSS.
4. In view of the above, the prayer for anticipatory bail is allowed.
5. Accordingly, I direct that, in the event of arrest, the petitioners, viz., (1) Md. Nehal Huda, (2) Md. Helal Huda, (3) Jamal Huda and (4) Ruhat Huda be released on bail upon furnishing a bond of Rs. 10,000/- each, with two sureties of like amount each, to the satisfaction of the learned Special Court, Electricity Act at Alipore and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that petitioner shall deposit 50% of the final assessment amount two weeks from date. They shall appear before the jurisdictional court and pray for regular bail within three weeks from date.
6. The application for anticipatory bail is, thus, disposed of.
