ORAL ORDER
1. Accused nos.1 to 5 in Crime No. 87 of 2026 registered by Holenarasipura Rural Police Station, Hassan District registered for the offences punishable under Sections 109, 118(1), 126(2), 189(2), 190, 191(2), 352 are before this Court in these two petitions filed under Section 482 of BNSS, 2023 seeking anticipatory bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.87 of 2026 was registered by Holenarasipura Rural Police Station, Hassan District, initially for

the aforesaid offences against petitioners herein, based on the first information dated 13.05.2026 received from Sri C.S.Balu, uncle of injured victim - Kushik Gowda. Apprehending arrest in the said case, petitioners had filed Crl.Misc.No.513 of 2026 and Crl.Misc.No.526 of 2026 before the jurisdictional Sessions Court, which was rejected on 11.06.2026. Therefore, they are before this Court in these two petitions.
4. Perusal of the material on record would go to show that, the allegation of assault on the victim Kushik Gowda, aged 21 years with a weapon on his face, is as against accused No.1-Nataraj. Other accused persons also allegedly had assaulted injured victim on his body with weapons. The wound certificate of the injured victim would go to show that, he had suffered three injuries as a result of assault made by accused persons. Out of the same, injury No.1 is said to be grievous in nature while other injuries are said to be simple injuries. Injury No.1 appears to be as a result of assault made by accused No.1 with a weapon on the nose of the injured victim. The wound certificate of the injured victim would go to show that, he had suffered fracture of his nasal bone as a result of said assault.

Under these circumstances, I am of the opinion that the prayer made by petitioner No.1/accused No.1 for grant of anticipatory bail cannot be entertained.
5. In so far as other accused persons are concerned, injuries suffered by the victim as a result of assault made by them are simple in nature. Under these circumstances, I proceed to pass the following:-
ORDER
(i) The Criminal Petition No.9017/2026 is partly allowed. (ii) Criminal Petition No.9017/2026 is dismissed as against accused No.1 and allowed as against other accused.
(iii) Criminal Petition No.9024/2026 is allowed.
(iv) The respondent - Police or any other Police in the State of Karnataka are directed to release the petitioners/ accused No.2 to 5 in the event of their arrest in Crime No.87/2026 registered by Holenarasipura Rural Police Station, Hassan for the offence punishable under Sections 109, 118(1), 126(2), 189(2), 190, 191(2), 352 of

BNS, 2023,
subject to the following conditions:
1. Petitioners / accused nos.2 to 5 shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this
order and shall execute a personal bond for a sum of Rs.1,00,000/- (One Lakh only) each with one surety each for the likesum to the satisfaction of the investigating officer.
2. Petitioners / accused nos.2 to 5 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. Petitioners / accused nos.2 to 5 shall not tamper with the prosecution witness and shall co-operate with the Police for investigation and appear before them whenever called upon.
4. Petitioners / accused nos.2 to 5 shall not involve in similar offences in future.
