The petitioners seek quashing of the proceedings in G.R. Case No. 1814 of 2024, arising out of Bhabanipur Police Station Case No. 217/2024 dated 31.07.2024, under Sections 109/115(2)/118(1)/351/3(5) of the Bharatiya Nyaya Sanhita, 2023, pending before the learned Additional Chief Judicial Magistrate, Haldia, Purba Medinipur, including Charge Sheet No. 224/2024 dated 30.09.2024, under Sections 115(2)/118(1)/109/351/3(5) of the Bharatiya Nyaya Sanhita,
2023. The present criminal case was instituted at the instance of Opposite Party No. 2 against his neighbours, who are the petitioners in this case. It has been submitted before this Court by the learned advocates appearing for the respective parties that the disputes
2 between them have been amicably resolved. In this regard, a joint application for compromise has been filed, being CRAN 2 of 2026. The report submitted by the State also confirms that the investigating agency has been duly informed of the compromise arrived at between the parties. This Court is of the view that the dispute in question is essentially a private dispute between neighbouring parties and does not have any adverse impact on public peace or tranquillity. In view of the principles laid down in (2014) 9 SCC 653 (Yogendra Yadav v. State of Jharkhand), this Court finds it appropriate to exercise its inherent jurisdiction in the facts and circumstances of the present case. Accordingly, G.R. case No. 1814 of 2024 arising out of Bhabanipur Police Station Case No. 217/2024 dated July 31, 2024, under Sections 109/115 (2) / 118 (1) / 351 / 3 (5) of the Bharatiya Nyaya Sanhita, 2023, is hereby quashed in view of the settlement arrived at between the parties. Consequently, CRR 137 of 2026 along with CRAN 2 of 2026 and CRAN 1 of 2026 stand disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
