1. This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 1st Court, Howrah to dispose of the injunction application filed in Title Suit No.365 of 2026 expeditiously.
2. The learned advocate appearing for the petitioners submits that the hearing of the injunction application was fixed on 21st September, 2026 but on the prayer of the petitioner, it has been preponed to 11th August,
2026. He further submits that the learned Trial Judge be directed to take up the hearing of the injunction application on the next date fixed.
3. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However,

the learned advocate for the petitioners shall be obliged to forward a copy of this application along with a server copy of this order upon the opposite parties or upon the learned advocate representing the opposite parties before the learned Trial Judge forthwith.
4. In the light of the submissions made by the learned advocate for the petitioner, CO 2587 of 2026 stands disposed of by requesting the learned Civil Judge (Senior Division), 1st Court, Howrah to take up the hearing of the injunction application on the next date fixed, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
5. All parties shall act on the basis of server copy of this order, duly downloaded from the official website of this Court.
6. Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
