Learned advocate appearing for the petitioner submits that the petitioner is in custody for about 9 months and charge- sheet has already been submitted before the jurisdictional court. Additionally, it has been submitted that both the petitioner and the victim were adult and were able to understand the consequences of the act.
Learned advocate for the State has produced the case diary.
I find from the materials wherein the petitioner maintained a physical relationship with the victim suppressing the
2 fact that he was married and was having a child of 15 years. Having considered the same, I am of the opinion that this is not a fit case for granting bail at this stage.
Accordingly, CRM(M)964 of 2026 is dismissed.
Memo of Evidence submitted by the State be kept with the record.
